Photo Contest Terms and Conditions
1. Contest Affiliation: North Bergen Purr is a charitable organization as described in §501(c)(3) of the Internal Revenue Code. This photo contest is sponsored by North Bergen Purr (hereinafter known as Sponsor). No social media platform or other organization or company is sponsoring or affiliated with this contest.
2. Eligible Participants: Anyone 18 years of age or older is eligible to participate. Sponsor reserves the right to verify, in its sole judgment, winner eligibility. Anyone cheating will be disqualified. Sponsor reserves the right to change these contest rules at any time.
3. Term: Contest is open from 9:00:00 AM (Eastern Time) on Friday, July 5, 2024 until 11:59:59 PM (Eastern Time) on Monday, August 5, 2024. By submitting an entry, each contestant agrees to the rules of the contest and states that he or she is 18 years old or older.
4. Entries: Entries are made at the contest website, http://gogophotocontest.com/NorthBergenPurr. You may enter as many times as you like and are encouraged to promote voting for your cat through various streams, including word of mouth, email, blogging, and social networking (Facebook, Instagram, Tiktok, X, Pinterest, Google+ etc.). Sponsor reserves the right to select, edit, and arrange submissions and to remove images from the contest website at any time at its sole discretion. Each entry requires a $10 donation.
Entrants warrant they own all rights to the photo they are submitting. You retain your rights to your photograph; however, by submitting photographic images to this contest, you grant Sponsor a perpetual, royalty-free license to use, reproduce, modify, publish, distribute, and otherwise exercise all copyright and publicity rights with respect to those photographic images at its sole discretion, including storing it on Sponsor servers and incorporating it in other works in any media now known or later developed including, without limitation, published books. If you do not wish to grant Sponsor these rights, it is suggested that you do not submit photographic images.
5. Voting: Anyone may vote as many times as they would like in any or all categories. To be considered a legitimate vote, a voter must visit the photo contest page http://gogophotocontest.com/NorthBergenPurr and click on the vote button under the photo or caption. Each vote requires a $1 donation.
6. Size Requirements: Image entries should be a minimum of 2016 x 3040 pixels per inch. The larger the photo, the better it will appear in the calendar. If a winning image is of low resolution, the Sponsor will contact the Potential Winner to request an image of high enough resolution to appear in the calendar.
7. Ethics: Inappropriate photos or comments will be removed. Sponsor reserves the right to deny consideration to any photo or caption for any reason.The welfare of a subject and its environment must be placed ahead of the desire to capture a photograph. Upon entering the contest, you certify that subjects were treated with respect and dignity, and that no people, wildlife or the environment were harmed in creating a photograph.
8. Contest Fees: Contest fees are contributions to the Sponsor, a nonprofit organization. In accordance with the Internal Revenue Service guidelines, Sponsor maintains discretion and sole control over the use of all contributions. Contributions are in US dollars and non-refundable. Contest entrants explicitly release Sponsor from any restrictions on how contributions are spent. No goods or services were provided in return for contributions. Contributions are tax-deductible to the limit allowed by law if the donor itemizes. Donations made to the Contest may not be tax-deductible in your jurisdiction and the Winner's prize may be taxable in your jurisdiction. Consult a tax professional. You agree that Sponsor is not providing any accounting, tax, or legal advice.
9. Use of Personal Data: Participation in the contest requires the collection of your name and email address. By entering this contest, you are consenting to the use of your name and email address for further communications regarding this contest.
10. Conditions of Entry: All entrants hold the Sponsors and their respective agents, directors, officers, employees, and volunteers (the "Indemnified Parties") harmless from and against all claims of any nature arising in connection with entrant's participation in the contest. The Indemnified Parties are not liable for any costs, damages, injuries, or other claims incurred because of entrants' participation in the contest. The Indemnified Parties are not responsible for incomplete or misdirected entries, technical or network malfunctions or failures, or causes beyond their control.
Entrants are solely responsible for their entries. Entrants may not submit materials that introduce any software viruses, worms or other programs designed to damage software, hardware or telecommunications equipment or are off-topic, partisan-political, contain advertising, nudity, personal attacks or expletives, or is otherwise abusive, threatening, unlawful, harassing, discriminatory, libelous, obscene, false, sexually explicit, or that infringes on the rights of any third party.
The contest is void where prohibited or restricted by law. The Sponsor reserves the right to cancel the contest or modify these rules at its discretion. The Sponsor reserves the right to disqualify any entrant whose entry or conduct appears in any way to inhibit the enjoyment of others; tamper with the competition; violate these rules or other applicable law or regulation; infringe on the rights of third parties; or act in an unsportsmanlike or disruptive manner. Decisions of the Sponsor are final and binding.
11. Verification of Winners, Prizes and Delivery of Prizes
Potential Winner(s) will be notified by email or phone within thirty (30) business days after being selected by Sponsor or its representative. Potential Winners are not Winners of any prize until their eligibility has been verified and they have received notice from Sponsor that they have won a prize, even if any information on Sponsor’s website on any other location indicates that an entrant has won. Potential Winner(s) may be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release.
If a Potential Winner cannot be contacted within forty-eight (48) hours after Sponsor attempts notification, is ineligible to win a prize, fails to return any and all requested documentation within the time stated on the notification (whether or not Potential Winner actually receives that notification), refuses the prize, or otherwise fails to comply with these Official Rules, then the Potential Winner forfeits the prize in its entirety. If a Potential Winner forfeits a prize, Sponsor will select a substitute Potential Winner by random drawing of the remaining eligible entries. Winners will be posted on the contest website http://gogophotocontest.com/NorthBergenPurr. The contest does not offer monetary or any other consideration for use of photos or for any other reason to contest Winners.
12. Use of Name and Likeness
Unless it is otherwise prohibited by law, by accepting any prize, each Winner expressly grants to Sponsor, and their respective designees, to use and publish his/her name, likeness, and photograph for advertising, promotional, publicity and other purposes in connection with this Contest ("Advertising") in any manner, in any and all media, now known or hereinafter devised, worldwide, in perpetuity, without further payment or consideration, notification, or permission (unless prohibited by law). Each Winner further agrees to execute any specific consent needed or requested by Sponsor or its designees in furtherance of such use. Sponsor never sells, exchanges or lends to third parties any address, email or telephone information you provide when entering this contest.
All copyright, trademark or other intellectual property rights in such advertising shall be owned by Sponsor and/or its licensors, and each winning participant hereby disclaims and waives any claim of right to such Advertising. Such Advertising shall be solely under the control of Sponsor and/or its licensors, and each Winner hereby waives any claim of control over the Advertising content as well as any possible claims of misuse of such winning recipient's name, likeness or voice under contract, tort or any other theory of law.
